General terms and conditions of business

1. registration
Registration for our events must be made via the website. A confirmation of registration and information about the course schedule will follow immediately. However, the participant is bound to his registration even without this written confirmation. No further contact will be made on our part.
With the registration the participant confirms that he/she has taken note of and accepts the general terms and conditions of POLEDANCE NRW.

2. waiting list
If an event is already fully booked, the participant will be given the opportunity to be entered on the waiting list for the desired event so that he or she can move up if a place becomes free. Entry on the waiting list is binding. Should it no longer be possible for the participant to accept a place, the entry must be deleted immediately.

3. fees
The fees at the time of registration apply. All fees include the sales tax valid in Germany at the time of registration.

4. services
Unless otherwise agreed, the fees stated include the provision of the premises required for the event, teaching content and the training service. Unless otherwise stated, the course language is German. The events are organised by POLEDANCE NRW. POLEDANCE NRW is entitled to have the services owed carried out by third parties.

5. health
The participant confirms with his registration that there are no objections against a training participation due to health reasons. The participant is aware that the training consists of dance and acrobatic elements that go beyond the usual dangers of a regular fitness program. The participant must inform POLEDANCE NRW of any physical limitations before the start of the course. In case of injuries or previous illnesses of the active or passive musculoskeletal system, the participant is obliged to consult a doctor beforehand and to present a clearance certificate. Participation in classes and other events is at your own risk. POLEDANCE NRW is only liable if damage is caused intentionally or by gross negligence on the part of a trainer.

6. terms of payment
The course fee is due on completion of the course and is to be paid into the bank account specified by POLEDANCE NRW without deduction.

7 Cancellation
Cancellation by the participant must be made in writing and is only free of charge for private and special events and workshops up to 21 days before the start of the event. In case of a later cancellation or no-show, the full fee will be charged. These regulations apply regardless of the reason for cancellation and also when a medical certificate is presented. The participant has the right to name a substitute participant at any time before the start of the training. Such a rebooking is free of charge for the participant. Only partial participation in the course does not entitle the participant to a reduction in payment.
Verbal collateral agreements and promises are not valid.

8. changes
POLEDANCE NRW reserves the right to move or cancel events for important reasons (e.g. insufficient number of participants). In the event of cancellation, POLEDANCE NRW will offer an alternative date or refund the course fee at the participant’s discretion. However, different event times on the same day and/or the use of a different trainer do not entitle the participant to a reduction in payment and/or cancellation.

9 Copyright and copyright protection
For copyright reasons and out of respect for the privacy of our participants, photography, filming, recording on tapes and other forms of transcription are not permitted on our premises.

10 Limitation of liability / exclusion of liability
POLEDANCE NRW accepts no liability for a concrete training success or the individual use of the contents. POLEDANCE NRW has unlimited liability in the event of damage for which it or its vicarious agents or legal representatives are responsible arising from injury to life, limb or health and in the event of intent or gross negligence. Otherwise, in the event of a breach of material contractual obligations, liability shall be limited to the foreseeable damage typically occurring. Beyond that, liability is excluded.

11. data protection
The personal data of the participant necessary for the course of the events will be stored on data carriers. The participant agrees to the collection, processing and use of this data for business purposes. The participant can revoke this consent at any time, in which case the data will be deleted after the transaction has been completed.

12 Final provisions
POLEDANCE NRW reserves the right to change its terms and conditions with effect for the future. With the announcement of these terms and conditions all previous versions lose their validity.

13 Jurisdiction
German law shall apply. The place of jurisdiction is Düsseldorf.

General terms and conditions of business

Membership
Persons under the age of 16 shall not be admitted as members.
POLEDANCE NRW only concludes contracts for the membership of minors with their legal representatives. Membership and course credit cannot be transferred.

2. membership fees
Membership
fees are charged for the possibility to use the courses offered – independent of the actual use by the member. The prices are valid for the minimum term and include the statutory value added tax at the time of the conclusion of the contract; in the event of a change in the value added tax rate, the price will be adjusted accordingly.

After the end of the minimum term, a price adjustment to the applicable price list shall be deemed to have been agreed.
Membership fees are due on the 3rd calendar day of each month and are collected by SEPA direct debit. Any return debit note fees incurred are to be borne by the member.
If payment is not received on time, reminder fees of € 2.50 per reminder stage will be due from the 2nd payment reminder onwards.

4 Termination by POLEDANCE NRW
a) POLEDANCE NRW may terminate the contract with 1 month’s notice to the end of the respective contract period.
b) POLEDANCE NRW may terminate the contract without notice for good cause. Good cause shall be deemed to exist in particular if
– The member is in arrears with two months’ dues or an amount equivalent to two months’ dues despite a reminder.
– The member repeatedly and seriously violates the rules, despite a warning.
If the member is responsible for the extraordinary termination, POLEDANCE NRW is entitled to assert claims for damages if necessary.

5 Termination by the member
a) The membership contract can be terminated by the member at the earliest at the end of the minimum term, observing the notice period of 1 month to the end of the term. If the membership is not cancelled or not cancelled in time, it is automatically extended by the agreed contract period.
b) Notices of termination must be in writing; they must be sent to office@poledance.nrw.

6. temporary blocking
If the member is in arrears with a membership fee, POLEDANCE NRW is entitled to refuse the use of the courses offered until the arrears have been paid.

7 Limitation of liability / exclusion of liability
POLEDANCE NRW is liable without limitation for damages resulting from injury to life, body or health for which it or its vicarious agents or legal representatives are responsible, as well as for intent or gross negligence. Otherwise, in the event of a breach of material contractual obligations, liability shall be limited to the foreseeable damage typically occurring. Beyond that, liability is excluded.
